Due to high application volumes, processing times for this pathway have increased, and many applicants are at risk of expiration of their temporary status in Canada before their applications for permanent residence are finalized. People with temporary status in Canada or their guardians are responsible for updating their status as necessary. Foreign nationals who submit an application for a Canadian work or study permit extension before their current permit expires will continue to have legal status until a decision is made on their extension application. This is called “maintaining state”. If an applicant’s temporary status expires within 90 days before applying for a new open work permit, they may apply under this public policy and have their status reinstated at the same time.
